By accessing effincut.com, submitting an application, purchasing a service, or engaging in any coaching relationship with EFFN CO. LLC, you agree to be bound by these Terms and Conditions in full.

If you do not agree with any part of these terms, do not use this site or engage with our services.

EFFN CO. LLC offers performance coaching services under the EFFINCUT methodology. Services include but are not limited to:

• The Executive Athlete Program: 12-week custom 1-on-1 performance coaching
• The Executive Diagnostic: 30-minute paid diagnostic call to identify the primary system bottleneck
• Monthly retainer coaching following program completion
• Custom training plans, nutrition protocols, and recovery systems delivered as part of the above
• Field Tools: standalone digital protocols and reference materials available for direct purchase and self-administered use

All services are delivered remotely. Scheduling, communication, and program delivery occur via agreed-upon digital channels.

You must be 18 years of age or older to purchase or participate in any service offered by EFFN CO. LLC.

By purchasing, you confirm that you are physically capable of engaging in an exercise and nutrition program and have consulted with or agree to consult with a licensed physician before beginning. EFFN CO. LLC reserves the right to decline or discontinue service at its sole discretion.

All payments are processed through Stripe. By submitting payment, you authorize EFFN CO. LLC to charge the agreed amount to your selected payment method.

Executive Diagnostic ($97). Non-refundable. The $97 fee is applied in full toward the Executive Athlete Program if you choose to enroll following the call.

Executive Athlete Program ($2,500 or split $1,400 x 2). Due to the custom nature of the program and the immediate delivery of materials upon enrollment, all payments are non-refundable outside of the guarantee terms outlined in Section 05.

Monthly Retainer ($800/month). Billed monthly. Either party may cancel with 14 days written notice prior to the next billing cycle.

Field Tools (digital downloads, $27 to $147). Non-refundable. Field Tools are standalone digital products delivered immediately upon purchase. Because access is granted and the underlying intellectual property is transferred in full at the moment of sale, no refunds, exchanges, or credits are issued. The Athlete's Promise guarantee outlined in Section 05 does not apply to Field Tools.

EFFN CO. LLC stands behind the Executive Athlete Program with the following service guarantee:

To qualify for this guarantee, the following conditions must be met:

• All 12 weekly check-in calls completed or rescheduled within the program window
• Training plan followed at 80% adherence or greater across the 12 weeks
• Nutrition guidelines followed with reasonable consistency as assessed by the coach
• A performance benchmark, defining system stabilization and movement of the first bottleneck, agreed upon and documented on day one of the program
• All program fees paid in full

Continuation coaching under this guarantee will be delivered at the same frequency and access level as the original program until the benchmark is reached.

Scope of guarantee. The Athlete's Promise applies exclusively to the Executive Athlete Program. It does not extend to the Executive Diagnostic, the Monthly Retainer, Field Tools, or any other product offered by EFFN CO. LLC.

Field Tools and self-administered materials. Field Tools are standalone digital products designed to be used independently by the purchaser without coaching oversight. EFFN CO. LLC provides the underlying frameworks and protocols as reference material; it does not supervise, monitor, or guarantee any outcome from independent application of these materials. Results vary based on individual circumstances, adherence, prior conditioning, and health status. By purchasing and using Field Tools, you accept that any outcome, lack of outcome, or consequence resulting from self-administered use is solely your responsibility. EFFN CO. LLC disclaims liability for results, injury, or other consequences arising from independent use of Field Tools to the fullest extent permitted by law.

You agree to engage with EFFN CO. LLC and its coaching services in good faith. This includes honest reporting of progress, adherence, and relevant health information that may affect program design.

EFFN CO. LLC reserves the right to terminate the coaching relationship without refund if a client is abusive, dishonest in material program reporting, or engages in conduct that makes continued coaching untenable.

The services, content, and communications provided by EFFN CO. LLC do not constitute medical advice, diagnosis, or treatment. All content is for informational and coaching purposes only.

You are solely responsible for consulting a licensed physician or qualified healthcare professional before beginning any exercise, nutrition, or lifestyle modification program. By enrolling, you confirm you have done so or accept full responsibility for choosing not to.

Results described on this site and in program materials reflect individual participant outcomes and are not guaranteed. Individual results depend on compliance, starting point, health status, consistency, and factors outside the control of EFFN CO. LLC.

Testimonials and case studies represent real outcomes from specific individuals under specific conditions. They are not a promise of what any other individual will achieve.

All content on effincut.com and all materials delivered as part of any EFFN CO. LLC program, including but not limited to text, frameworks, methodologies, protocols, program names, and brand assets, are the exclusive intellectual property of EFFN CO. LLC.

• You may not reproduce, distribute, sell, or share program materials without written permission
• You may not present EFFINCUT methodologies as your own in any coaching, consulting, or commercial context
• Personal use of delivered materials within your own program is permitted and encouraged

Violations of these terms may result in immediate program termination and legal action.

EFFN CO. LLC's total liability to any client or site user is limited to the total amount paid for services in the preceding 12 months.

EFFN CO. LLC is not liable for indirect, incidental, consequential, or punitive damages arising from participation in any program, use of this site, or reliance on any content or coaching communication.

This limitation applies to the fullest extent permitted by Florida law.

Either party may terminate the coaching relationship at any time. Client-initiated termination does not entitle the client to a refund of fees already paid except as outlined in Section 05.

EFFN CO. LLC reserves the right to terminate any coaching relationship without prior notice in the event of:

• Abusive, threatening, or harassing conduct directed at the coach
• Material misrepresentation of health status or program adherence
• Violation of intellectual property terms outlined in Section 09
• Non-payment of agreed fees

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from or related to these terms or the services provided by EFFN CO. LLC will be resolved in a court of competent jurisdiction located in Florida.

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full effect.
